Supreme Court Agrees to Hear Appeal on Law Banning TikTok

The Supreme Court has agreed to hear TikTok’s appeal of the federal law that would ban the China-owned company. 

“Congress’s unprecedented attempt to single out applicants and bar them from operating one of the most significant speech platforms in this Nation presents grave constitutional problems that this Court likely will not allow to stand,” TikTok’s lawyers wrote in their request. 

The potential TikTok ban has been heavily discussed over the past year. The U.S. government requested that the company divest from Chinese parent company ByteDance — a request TikTok has refused.

The Supreme Court will hear arguments on Jan. 10, 2025, giving them time to reconsider the proposed bill, which is set to go into effect Jan. 19. 

Variety reported that TikTok’s representatives and the Court will “brief and argue the following question: Whether the Protecting Americans from Foreign Adversary Controlled Applications Act, as applied to petitioners, violates the First Amendment.”

According to the Court’s docket, two hours have been allotted to hear arguments. 

“We’re pleased with today’s Supreme Court order,” TikTok said in a statement about the agreement. “We believe the Court will find the TikTok ban unconstitutional so the over 170 million Americans on our platform can continue to exercise their free speech rights.” 

TikTok has faced a lot of opposition. On Dec. 6, a panel of D.C. judges denied their bid to overturn the law. A week later, an appeals court denied their request to delay the law from taking effect.

Many are wondering if President-Elect Trump will keep the law banning the app from taking effect. 

At a recent press conference, he was noncommittal, telling reporters, “Tiktok had an impact, and so we’re taking a look at it. I have a little bit of a warm spot in my heart. I’ll be honest.”
