Judge Dismisses Lawsuit Against Nirvana Over Album Cover

The lawsuit filed by Spencer Elden against grunge band Nirvana has been dismissed by a judge.

Elden, who appeared on the group’s “Nevermind” album cover as a baby, filed a lawsuit against lead singer Kurt Cobain’s estate and the band’s surviving members that claimed they violated federal child pornography statutes and sexually exploited him.

While non-sexualized nude photos of infants are generally not classified as child pornography in a court of law, Elden and his lawyer, Robert Y. Lewis, said that because money is also in the picture, it makes the infant appear “like a sex worker.”

Elden, 30, wants $150,000 from each of the defendants who include “surviving band members Dave Grohl and Krist Novoselic; Courtney Love, the executor of Kurt Cobain’s estate; Guy Oseary and Heather Parry, managers of Cobain’s estate; photographer Kirk Weddle; art director Robert Fisher; and a number of existing or defunct record companies that released or distributed the album in the last three decades,” according to Variety.

Elden previously said that the album cover photo caused him “lifelong damage” and claims that neither he nor his guardians consented to the naked photoshoot.

His suit claims that the band, the photographer, and the record labels “intentionally marketed Spencer’s child pornography and leveraged the shocking nature of his image to promote themselves and their music at his expense.”

Dave Grohl, the band’s drummer, told the Sunday Times, “I think that there’s much more to look forward to and much more to life than getting bogged down in those kinds of things.”

According to court documents, Elden has until January 13, 2022 to file a second amended complaint.
